By accessing the Website, purchasing a product or program, using the 63-Day Goal Calculator, participating in coaching, or otherwise using our Services, you agree to these Terms.
If you do not agree to these Terms, please do not use the Website or purchase or participate in our Services.
1. New Wave Weight Loss Systems
New Wave Weight Loss Systems provides weight-management and general wellness products, educational resources, nutrition guidance, structured routines, accountability, and coaching support.
The New Wave program is designed to provide customers with an organized approach to their weight-management goals.
New Wave does not replace individualized medical care, diagnosis, treatment, or medical nutrition therapy from a licensed healthcare professional.
2. The 63-Day New Wave Program
New Wave Weight Loss Systems offers a structured 63-day weight-loss program designed to support customers as they work toward their individual weight-management goals.
The program may include, depending upon the package purchased:

- Nutrition guidance
- Structured program routines
- Accountability support
- Progress guidance
- Virtual coaching
- Access to recipes and nutrition resources
- Other materials or benefits identified at the time of purchase

3. Weight-Loss Results

Individual results vary.

6. Purchases

- You are authorized to use the payment method submitted.

8. Payment Processing

9. Affirm Financing
New Wave may provide customers with access to financing through Affirm or another third-party financing provider.
Financing is not provided by New Wave Weight Loss Systems.
Financing availability, eligibility, approval, interest rates, payment amounts, repayment schedules, late-payment consequences, and other financing terms are determined by the applicable financing provider.
Selecting a financing option does not guarantee approval.
Any financing agreement is between you and the applicable financing provider and is governed by that provider’s terms.
10. Final Sale Policy
Except where otherwise expressly stated or where applicable law requires otherwise, New Wave Weight Loss System purchases are final sale.
Due to the nature of the products, program materials, coaching access, educational resources, and other components that may become available following purchase, we generally do not offer refunds, returns, exchanges, or store credits after an eligible order has been processed.
Nothing in this section limits any non-waivable rights or remedies available to consumers under applicable law.
11. Order Cancellations and Changes
Orders generally begin processing after they are submitted.
Except where required by applicable law or expressly permitted by New Wave, orders cannot be canceled or changed once processing has begun.
Customers are responsible for reviewing their order and shipping information before completing checkout.
If you discover an error immediately after ordering, contact New Wave as soon as possible. We cannot guarantee that an order can be changed after submission.
12. Shipping and Delivery
Shipping and delivery estimates are estimates and are not guarantees unless expressly stated otherwise.
Processing and delivery may be affected by:
- Order volume
- Weekends and holidays
- Carrier delays
- Weather
- Incorrect or incomplete addresses
- Transportation disruptions
- Supply interruptions
- Events outside our reasonable control
Once a shipment has been transferred to a carrier, delivery operations are generally controlled by that carrier.
Customers are responsible for providing a complete and accurate shipping address.
New Wave is not responsible for delays caused by inaccurate information supplied by the customer.
13. Damaged or Incorrect Orders
If your shipment arrives damaged or you believe you received an incorrect product, please contact New Wave promptly.
When requested, you may be required to provide:
- Your name
- Order number
- Photographs of the shipping package
- Photographs of the product
- Photographs showing the damage or error
- Other information reasonably necessary to investigate the issue
Reporting an issue does not automatically entitle a customer to a refund. New Wave will review qualifying claims and determine an appropriate remedy consistent with applicable law and our policies.
14. Virtual Coaching
Certain New Wave packages may include a specified period of virtual coaching.
Coaching is intended to provide general wellness education, nutrition guidance, accountability, motivation, and program support within the scope of the applicable service.
Coaching does not create a physician-patient relationship or other licensed healthcare-provider relationship merely because coaching services are provided.
Customers remain responsible for their personal decisions, dietary choices, physical activity, adherence, and obtaining appropriate medical care when necessary.
Coaching availability, communication methods, appointment procedures, and other program details may be established separately.
15. Coaching Participation
Customers are expected to participate respectfully and appropriately in coaching services.
New Wave reserves the right to restrict or terminate coaching access for conduct including:
- Harassment
- Threats
- Abusive behavior
- Fraudulent activity
- Misuse of program resources
- Unauthorized recording or distribution of coaching sessions
- Repeated violations of program policies
Termination for misconduct does not necessarily create a right to a refund.
16. Missed Coaching Sessions
If scheduled coaching appointments are included with your package, customers are responsible for attending appointments as scheduled and following any cancellation or rescheduling requirements communicated for the coaching program.
Missed sessions, late cancellations, or unused coaching benefits may expire according to the terms disclosed for the applicable program.
Purchasing a program does not guarantee indefinite access to unused coaching services.
17. 63-Day Goal Calculator
The 63-Day Goal Calculator is provided as a general educational tool.
Calculator results may include estimates concerning:
- Body mass index (BMI)
- Estimated energy requirements
- Estimated maintenance calories
- General calorie planning information
- Protein planning estimates
- Hydration estimates
- Current-to-goal weight differences
- A 63-day weight-loss goal perspective
These calculations are mathematical estimates based upon information entered by the user.
They are not individualized medical recommendations.
Actual nutritional and energy requirements may differ significantly from calculator estimates.
You should not use the calculator to diagnose a medical condition, determine whether medication is necessary, replace professional nutritional counseling, or make significant medical decisions.
18. Nutrition and Recipe Information
Recipes, meal ideas, nutrition articles, calorie information, food suggestions, hydration information, and other nutritional content on the Website are provided for general educational purposes.
Nutritional values may be estimates and can vary based upon ingredients, brands, serving sizes, preparation methods, substitutions, and measurement differences.

Where the New Wave program includes or discusses supplements or wellness products, customers should follow the product label and applicable directions.
Do not exceed recommended usage.

New Wave may publish testimonials, reviews, photographs, weight-loss results, or other customer experiences with appropriate authorization.

They are not guarantees or representations that every customer will achieve the same or similar results.
22. Intellectual Property
Unless otherwise indicated, the Website and New Wave materials—including the New Wave name, branding, program materials, written content, graphics, recipes created for the program, educational materials, downloadable resources, page designs, photographs owned by New Wave, and other proprietary materials—are owned by or licensed to New Wave and are protected by applicable intellectual-property laws.
You may use program materials for your personal, noncommercial participation in New Wave.
You may not, without prior written authorization:

- Sell or resell New Wave materials
- Copy or distribute proprietary program content
- Publish paid program materials online
- Create derivative commercial programs from proprietary New Wave content

23. Website Use
You agree not to misuse the Website.
Prohibited activities include attempting to interfere with Website security, introducing malicious software, accessing restricted systems without authorization, scraping content in violation of applicable law, impersonating another person, conducting fraudulent transactions, or using the Website for unlawful purposes.

New Wave does not control independently operated third-party services.
Your use of a third-party service is governed by that provider’s terms, privacy policy, and other applicable agreements.

The Website may occasionally be unavailable because of maintenance, hosting problems, security issues, updates, technical failures, or circumstances outside our control.
26. Disclaimer of Warranties

We do not warrant that the Website will always operate without interruption or that every piece of information will be free from technical or typographical error.
Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be excluded.

This provision does not require a consumer to indemnify New Wave for New Wave’s own unlawful conduct where prohibited by law.

Our Privacy Policy explains how information may be collected, used, disclosed, and protected when you interact with New Wave Weight Loss Systems.
30. Electronic Communications

Nothing in these Terms deprives a consumer of rights that cannot legally be waived.
33. Disputes
Before initiating formal litigation concerning a dispute arising from a New Wave purchase or Service, we encourage customers to contact us so that we have a reasonable opportunity to investigate and attempt to resolve the matter.
Nothing in this provision prevents either party from exercising rights or remedies that cannot lawfully be restricted.
I intentionally have not inserted a mandatory arbitration clause or class-action waiver into this template. Those provisions have significant legal consequences and should be drafted and implemented with California legal counsel if New Wave decides to use them.
34. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by law.
35. No Waiver
A failure by New Wave to enforce a provision of these Terms on one occasion does not necessarily waive the right to enforce that provision in the future.
36. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms expressly presented at the time of purchase, constitute the applicable agreement regarding use of the Website and Services, subject to rights that cannot be waived under applicable law.
If specific written terms presented for a particular product or service conflict with these general Website Terms, the more specific terms will control with respect to that product or service to the extent permitted by law.

New Wave may update these Terms periodically to reflect changes in our Services, business practices, technology, or applicable law.
The “Last Updated” date at the top of this page will indicate the most recent revision.
Changes will apply prospectively as required by applicable law and will not retroactively eliminate rights that have already accrued.
